This is our standard client agreement upon which we intend to rely. For your own benefit and protection you should read these terms carefully before signing them. If you do not understand any point please ask for further information.

Notes on notification types and payment
A Standard Notification is a notification where the time period in clear working days between notification and proposed movement is in accordance with that required by the Special Types General Order 2003. This means that a notification submitted requiring two clear working days cannot take place until the third working day after the notice is given. A notification requiring five clear working days cannot take place until the sixth working day after the notice is given – effectively a week later.
A Short Notice Notification is a notification where the time period in clear working days between notice and proposed movement is less than that required by the Special Order. Short Notice Notifications often require us to make telephone contact with some authorities, and their agreement that a movement can take place before the time period expires cannot be guaranteed.
A Repeat Notification is a notification which is a repeat of an Abnormal Load Notification made previously in which the only changes are to the reference number and dates of movement and is not a Short Notice Notification.
An Out of Hours Notification is a notification which the Client requests and the AbHaulier service compiles and transmits outside of Normal Business Hours, 9:00am to 5:00pm Monday to Friday.
An Emergency notification is a notification where the notification is requested and submitted on the same day that the movement is due to take place.
A VR1 application is an application made to National Highways where the loaded vehicle width exceeds 5m. At least 10 days should be allowed for the application to be processed before any movment takes place.
Cascade will invoice every 30 days. Payment may be made BACS. Cheques are not accepted.
Terms and Conditions
1 Definitions and interpretation
The following terms shall have the meanings assigned below:-
‘AbHaulier’ means the computer software program for the computer based generation and transmission of Abnormal Load Notifications developed by Cascade Software Limited.
‘Abnormal Load Notification Services’ or the ‘Service’ means notification services as defined in Clause 2 below in respect of proposed abnormal load movements which the Client wishes to undertake on the public highway and requests Cascade to notify to Relevant Authorities.
‘Abnormal Load Notifications’ means notifications of these proposed abnormal load movements made in accordance with the Special Types General Order.
‘Relevant Authorities’ means Structure Owning Authorities and Police Forces on the proposed route.
‘Special Order’ or ‘Special Types General Order’ means The Motor Vehicles (Authorisation of Special Types) (General) Order 2003 (S.I. 2003 No. 1998) and all subsequent amending legislation.
‘Time Period’ means the Time Period in Working Days which the Special Order requires to elapse between submission of a notification and the movement set out in that notification taking place.
‘Agreement’ means these Terms and Conditions of Service which every AbHaulier Service Client has accepted either by clicking the appropriate box online or by signature of a paper copy.
‘Client’ means an AbHaulier Service Client who has accepted these Terms and Conditions of Service and who requests Abnormal Load Notification Services.
‘Normal Business Hours’ means the hours from 9.00am to 5.00pm Monday to Friday excluding Bank Holidays. ‘Out of Hours’ means all times outside of Normal Business Hours.
‘Operational Data’ means all incoming and outgoing messages relating to Abnormal Load Notifications, the AbHaulier database and any other data relating to the Client’s notifications and vehicles.
‘Standard Notification’ means an Abnormal Load Notification where the Time Period between notice and proposed movement is in accordance with the requirements of the Special Order.
'Short Notice Notification’ means an Abnormal Load Notification where the Time Period between notice and proposed movement is less than that required by the Special Order. Short Notice Notifications are subject to the agreement of the relevant Authorities which cannot be guaranteed.
‘Repeat Notification’ means an Abnormal Load Notification which is a repeat of an Abnormal Load Notification made previously in which the only changes are to the reference number and dates of movement and for which the Time Period is in accordance with the requirements of the Special Order.
‘Out of Hours Notification’ means an Abnormal Load Notification which the Client requests and Cascade compiles and transmits outside of Normal Business Hours.
‘Schedule of Rates’ means the Schedule of Rates current at the time the Client requests an Abnormal Load Notification as published on the www.cascadesoft.co.uk website.
‘Working Days’ means Monday to Friday inclusive but excluding Bank Holidays.
2 Services to be provided
Cascade shall provide Normal Abnormal Load Notification Services which shall comprise inter alia the following duties:-
- Preparing and sending Abnormal Load Notifications on behalf of the Client when requested during Normal Business Hours
- Responding to Abnormal Load Notification replies and telephone calls from Relevant Authorities during Normal Business Hours
- Copying all original and amended Abnormal Load Notifications to the Client’s designated email address
- Operating an Out of Hours Abnormal Load Notification Service for Urgent or Emergency Notifications which are required to be notified outside of Normal Business Hours
Notification requests received after 3:00pm (2:00pm on Fridays) may not be sent until the following working day, unless requested and paid for as Out of Hours.
2a Haulier agreement of responsibility
It is the responsibility of the haulier to check all notification details are correct on receipt of the submitted abnormal load notification.It is the responsibility of the haulier to ensure the driver of the notified abnormal load vehicle route has viewed and checked the full route using the map link provided within the notification for this purpose.
It is the responsibility of the haulier to ensure the driver of the abnormal load vehicle has read the full the step by step driving instructions included within the notification.
Any changes to an abnormal load notification are made free of charge. It will be deemed that the haulier has accepted the notification details and route as correct if changes to the notification are not requested within 3 hours of receiving a copy of the notification by email.
3 Fees
The Client shall pay fees to Cascade for Abnormal Load Notification Services determined by the number of notifications of each type and calculated in accordance with the Schedule of Rates current at the time of each request.
4 Payment
4.1
For monthly accounts Cascade will submit an invoice at the end of each month supported by such evidence as may be reasonably required to prove that the sums included in each invoice are properly due and payable. Monthly account invoices must be paid within 14 days from their date.
4.2
All sums due under this Agreement are exclusive of Value Added Tax, the amount of which shall be paid by the Client to Cascade at the rate and in the manner prescribed by law.
5 Provision of data
5.1
With each Abnormal Load Notification request the Client will supply the necessary Operational Data defining the movement as required by the Special Order. Some vehicle data which does not change may for convenience be retained by AbHaulier.
5.2
All Operational Data shall be considered to be and remain the sole property of the Client. It is agreed that Cascade may retain copies of Operational Data and use such data for development and promotional purposes.
6 Commencement and termination
6.1
This Agreement will commence when the Client makes his first request for Abnormal Loads Notification Service.
6.2
This Agreement may be terminated by either the Client or Cascade giving the other party one week’s notice to that effect, unless mutually agreed otherwise. Clauses 1, 4, 5 and 9 will remain in effect indefinitely.
7 Transfer of Agreement and provision of service
It is agreed that Cascade may transfer the benefit and rights of this Agreement to another party providing that the other party uses the AbHaulier program to provide the Abnormal Loads Notification Service and the provisions of this Agreement are fully transferred to that party.
8 Indemnity
The Client agrees to provide a full and complete indemnity to Cascade against any claim arising from the performance of the Normal and Additional Services to be provided under this Agreement.
10 Disputes and differences
10.1
The parties shall attempt in good faith to settle any dispute.
10.2
If the dispute is not resolved within four weeks the parties will resolve it through an Alternative Dispute Resolution Procedure recommended to them by the Centre for Dispute Resolution.
11 Notices
Any notice to be given under this Agreement shall be in writing and sent by first class letter post to the party to be served at its address set out in this Agreement or such other address as may from time to time be supplied for the purpose of this clause. Notices shall be deemed to have been received 48 hours after posting.
10 Governing law
The validity, construction and performance of this Agreement shall be governed by the laws of England and Wales
